A state appeals court ruled Thursday morning that it was unconstitutional to force protest singers at the State Capitol to get a permit. The 4th District Appellate Court in Madison agreed with a Dane County circuit judge's decision to throw out a citation against Michael Crute of Middleton.

A 41-year-old Wausau man accused of having sexual contact with a 6-year-old girl is expected to be charged Friday. Court documents show Christopher Burns will be charged with two counts of first degree sexual assault of a child and child enticement.

The Dane County Sheriff's Office said deputies responded to a report of a structure fire at 4272 Highway 78 in the town of Vermont at 4:50 a.m. Black Earth, Mazomanie and Mount Horeb fire departments also responded. The two occupants discovered the fire after waking to the smell of smoke, the report said.

Madison police are now recommending the Dane County District Attorney charge 36-year-old Roy Smith with first degree reckless homicide. The actual charging decision is up to the district attorney.

Police on Thursday asked the district attorney to charge one of the suspects in a north Madison death investigation with homicide. The Madison Police Department said it has recommended to the Dane County District Attorney that Roy Smith Jr., 36, of Fitchburg, be charged with first-degree reckless homicide in the death of 26-year-old Lonzell Daniel , of Chicago.
